OCI Penalty Waiver 2026:
Update Your Passport Details After 90 Days
By OCI Gateway • Updated 7 November 2026
The Government of India has waived the US$25 penalty for delayed OCI passport updates for fresh applications submitted between 1 November and 31 December 2026, inclusive. If your British or other foreign passport was issued more than 90 days ago and your OCI still shows your previous passport details, this temporary waiver gives you an opportunity to bring your record up to date without the late-update penalty.

31 December 2026
Fresh passport-update applications submitted 1 November–31 December 2026, inclusive.
The official consular notice confirms the application window. The waiver removes the specified penalty; you still need to submit the passport update.
OCI Gateway helps UK applicants check their documents, prepare the online application and access their updated eOCI after approval.
What is the OCI passport update penalty waiver?
OCI holders are required to update their passport particulars when a new passport is issued. The normal deadline is within 90 days of the passport’s issue date. A US$25 late-update fee ordinarily applies when the update is submitted beyond that period.
The current one-time concession waives that penalty during the announced application window. The official OCI portal confirms that the waiver runs until 31 December 2026.
| Key point | What it means |
|---|---|
| Penalty waived | US$25 for delayed updating of passport details |
| Application window | 1 November–31 December 2026, inclusive |
| Applications covered | Fresh passport-details update applications submitted during that window |
| Normal update deadline | Within 90 days of the new passport’s issue date |
| Action still needed | Submit the update through OCI Miscellaneous Services |
My passport was issued over 90 days ago. Can I still update my OCI?
Yes. You can still apply to update your OCI after 90 days. The waiver is intended to help cardholders who have missed the normal passport-update deadline.
AN EXAMPLE
For example, if your current passport was issued in June 2026 and you have not yet updated your OCI, a fresh passport-details update submitted during the waiver window falls within the period described in the notice.
The relevant window concerns when the update application is submitted, rather than requiring your passport to have been issued in November or December.
If your passport was renewed several years ago, or you have renewed it more than once since your last OCI update, tell us which passport is currently linked to your record. We can review the details and explain what to prepare.
Do I need a VFS appointment for an OCI update after 90 days?
During the waiver period, a standard OCI passport-details update can be completed online without visiting a VFS centre—even if your passport was issued more than 90 days ago.
This makes it a good time to bring your OCI record up to date while avoiding a VFS visit and benefiting from the US$25 late-penalty waiver. Apply as soon as possible and submit your application by 31 December 2026, allowing time to prepare the documents and complete the online form.
OCI Gateway can check your documents, prepare your application and help with the photograph, signature and supporting uploads. If your name, nationality or other personal details have also changed, tell us so we can explain any additional requirements.
Documents required for an OCI passport update

Already applied or received a late-fee payment request?
The waiver notice refers to fresh applications submitted within the stated dates. It does not explain how every earlier pending application or existing payment request will be handled.
If you have already applied, send us your application reference, submission date, current status and the exact message received. Do not cancel or submit a duplicate application simply to try to obtain the waiver. An existing payment request should be checked with the issuing authority or VFS where relevant.
If you have already paid the penalty, the published waiver notice does not set out a refund process. Ask the organisation that collected the payment about your case, keeping the receipt and application reference ready.
Can I travel while my OCI passport update is processing?
For passport-details updates, the High Commission of India in London has confirmed that travel is permitted while the application is being processed.
Keep your valid current passport, OCI documentation and the old passport linked to your OCI ready for travel. If the old passport is unavailable, other personal details have changed, or you have received specific instructions about your OCI, confirm the requirements with the relevant Indian mission and your airline.
The penalty waiver does not guarantee that your update will be approved before a booked flight. Tell us your travel date when you enquire.
OCI penalty waiver FAQs
Does the waiver apply to children’s OCI passport updates?
The official notice is addressed to OCI cardholders without an adult-only restriction. Current guidance requires passport updates regardless of age. Tell us the child’s passport issue date so we can review their application and any parental documents needed.
Has the OCI 90-day rule been removed?
No. The temporary concession concerns the late-update penalty. You should continue to update your OCI within 90 days whenever a new passport is issued.
Must my OCI update be approved by 31 December 2026?
The notice specifies the dates when fresh applications must be submitted, rather than requiring approval by the deadline. Allow enough time to prepare and submit the application; contacting an agent or saving an unfinished form is not submission.
What happens after 31 December 2026?
That is the published end date of the waiver. Unless the government announces an extension or another change, applicants should expect the normal late-update fee arrangements to apply afterwards. Check the official portal for further announcements.
